Goumi Terms of Use

1. This agreement, and who we are

These Terms of Use (“Terms”) are an agreement between you and Generate Your Audience Pty Ltd, an Australian company (“Generate Your Audience”, “we”, “us”, “our”), covering your use of the Goumi iOS app, the goumi.ai website, and related services (together, the “Service”). By creating an account or using Goumi, you accept these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

Goumi is distributed through the Apple App Store, so Apple's standard Licensed Application End User License Agreement also applies. These Terms are between you and Generate Your Audience only — Apple is not a party to them and is not responsible for the Service, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Maintenance and support for Goumi is our responsibility, not Apple's.

2. The Service

Goumi is a voice-first AI cooking assistant: it creates recipes through AI chat, plans meals, manages your pantry, and guides you through cooking hands-free with voice, multi-dish timing coordination, and cook timers. We're always improving Goumi, so features may change, be added, or be removed over time.

3. Your account

• You must be at least 18 years old to create an account.
• Provide accurate information and keep it up to date — one account per person.
• Keep access to your account secure (your Apple ID, and the email address you sign in with). You're responsible for activity under your account. If you suspect unauthorised use, tell us at hello@goumi.ai.
• You can delete your account at any time in the app (Profile → Delete account).

4. Subscriptions and billing

Some features require a Goumi Pro subscription, purchased through the Apple App Store:

Prices may vary by region and are always shown in the app before you purchase.

• Billing. Payment is charged to your Apple ID at confirmation of purchase. We never see your card or payment details — billing is handled entirely by Apple.
• Auto-renewal. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Free trial. The monthly plan includes a 1-month free introductory trial. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing and cancelling. Manage or cancel anytime in your App Store account settings (Settings → your name → Subscriptions). Cancelling stops the next renewal; you keep access until the end of the period you've paid for. Deleting the app does not cancel your subscription.
• Refunds. Refunds are handled by Apple under the App Store terms — request one at reportaproblem.apple.com. Nothing here limits your rights under the Australian Consumer Law (see section 10).

5. Your content

You keep ownership of everything you put into Goumi — your recipes, photos, documents, chat messages, and notes. So that Goumi can work, you grant Generate Your Audience a licence to host, store, and process your content to provide the Service, which includes sending it to the AI providers listed in our Privacy Policy to generate recipes, meal plans, and voice responses. This licence exists only to run the Service for you and ends when you delete the content or your account (subject to the retention details in the Privacy Policy).

You must have the rights to anything you upload. Don't upload content that belongs to someone else without permission, or content that's unlawful.

6. AI-generated content and food safety — please read

Goumi's recipes, nutrition figures, cooking times and temperatures, and storage and reheating guidance are generated by AI and may be inaccurate, incomplete, or unsuitable for your situation. Cooking is still in your hands:

• Food safety is your responsibility. Handle food safely, and check doneness and internal temperatures yourself — don't rely solely on AI-suggested times and temperatures.
• Allergies and dietary needs. Always verify every ingredient against your own allergies and dietary or medical requirements. Goumi's dietary preferences and filters help tailor suggestions, but they are not a guarantee that a recipe is safe for you.
• Nutrition figures are estimates. They are derived from listed ingredients and vary with portions, brands, and substitutions. They are not medical or dietetic advice — if you have a medical condition, consult a qualified professional.
• Storage and reheating guidance is general. Use your own judgement and local food-safety guidance.

7. Acceptable use

Please don't:

• abuse, overload, or interfere with the Service, or access it by any means other than the app and website;
• submit unlawful, infringing, or harmful content in chats or uploads;
• reverse engineer, copy, resell, or create derivative works from the Service;
• scrape the Service or use it to build a competing dataset or product;
• use another person's account or misrepresent who you are.

8. Intellectual property

The Goumi app, website, brand, design, and all content we create belong to Generate Your Audience Pty Ltd or its licensors. The “Goumi” name and logo are our trade marks. These Terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial cooking — and no other rights in our intellectual property. Your own content remains yours (section 5).

9. Termination

You can stop using Goumi and delete your account at any time in the app. We may suspend or terminate your access if you breach these Terms, if the law requires it, or if it's necessary to protect the Service or other users. Sections that by their nature should survive (including sections 5, 6, 8, 10, and 11) survive termination.

10. Disclaimers and limitation of liability

Your rights under the Australian Consumer Law come first. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the ACL; for major failures you are entitled to the remedies the ACL provides. Where our liability can lawfully be limited but not excluded, it is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.

Subject to the paragraph above and to the maximum extent permitted by law: the Service is provided “as is” and “as available”; we don't warrant that it will be uninterrupted or error-free, or that AI-generated content will be accurate; and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss arising from reliance on AI-generated recipes, nutrition estimates, or cooking guidance. Subject to the same carve-outs, our total aggregate liability relating to the Service is limited to the amount you paid us in the 12 months before the claim.

11. Governing law

These Terms are governed by the laws of Australia, and the Australian courts have non-exclusive jurisdiction. Nothing in this section limits any mandatory consumer-law rights you have in your country of residence. If something's wrong, contact us first — most things can be sorted out with an email.

12. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here with a new “Last updated” date and, for material changes, let you know in the app. Continuing to use Goumi after changes take effect means you accept the updated Terms.
